06/02/2026 D/L - 50 Court No.28 S. Kundu Rejected C.R.M.(A) 257 of 2026 In Re: An application for anticipatory bail under Section 482 of the BNSS, 2023. In connection with Malda P.S case no. 782 of 2025 dated 8/11/2025 under sections 329(4)/115(2)/117(2)/109/74/308(3)/351(2)/324(4)/303 (2)/3(5) of the BNS.

In the matter of: Sunil Chowdhury & Anr.

...Petitioners.

Mr. Avinaba Patra ...for the petitioner.

Ms. Baisali Basu Mr. Anindya Sundar Chatterjee ...for the State.

1. Learned counsel appearing for the petitioners submits as follows. There is a dispute regarding property between the private parties. The petitioners have been falsely implicated in this case.

2. Learned counsel appearing for the State opposes the prayer for anticipatory bail. He relies on the case diary and submits that the petitioners and others had earlier demanded Rs.10 lakhs from the victim for purchasing the property. As the same was not given, the petitioners and others in a group being armed with weapons attacked the house of the de-facto complainant ransacked articles, assaulted the inmates and molested the female members. Reliance was placed on the statements of witnesses and of neighbours which implicate the present petitioners as also injury report and the seizure list for broken articles.

3. Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case to grant anticipatory bail to the petitioners.

4. Accordingly, the application for anticipatory bail is rejected.
