The petitioner is an Assistant Teacher of the subject History at Sagar Moniruddin High Madrasah, District - 24 Parganas (South). The petitioner is praying for general transfer.

The West Bengal Madrasah Service Commission has issued a notice bearing Memo No: MSC/Notice/04/2023 dated May 17, 2023 inviting applications for general transfer from the teachers, in response to it, the petitioner had made online application through relevant portal, but the same was not considered for want of necessary 'No Objection' from the authorities of the Madrasah, where the petitioner is now working.

The petitioner is claiming that such 'No Objection' has been issued subsequently on April 26, 2023 and the same has been submitted before the Commission on May 03, 2023.

Mr. Mukherjee, learned advocate appears on behalf of the Commission and submits that if the wanting 'No

Objection Certificate' is submitted before the Commission, her application for general transfer would be considered. The petitioner is directed to approach the Commission within a week from date with all the relevant documents for consideration of her prayer for transfer.

The Commission thereafter shall consider the said prayer of the petitioner in accordance with law. W.P.A. 1279 of 2024 is disposed of with the above observations without any order as to costs.

Since no affidavit has been invited, the allegations made in the writ petition are deemed to have been denied by the respondents.
