Report submitted by the learned advocate appearing for the State be also kept with the record. The petitioners complain that the private respondents in order to grab their property are resisting them from entering their property and also influencing the villagers for a social boycott. Learned advocate appearing for the State submits that the present petitioners who are before this Court are resident of Kolkata having their original abode at Purba Bardhaman. State also disputes that there is any problem and whenever the petitioners approached the police authorities, G.D. entries have been recorded.

The petitioners would inform the Kalna Police Station 48 hours ahead before they intend to visit their native place or their original abode. If there is any threat perception, the police authorities would ensure providing proper escort for the petitioners to enter their residence at Kalna.

The police

authorities would thereafter keep a strict vigil and ensure that no breach of the peace or tranquility takes place because of the petitioners' staying at their original abode at Kalna.

The directions passed above are subject to condition that the petitioners have a demarcated or proportionate area in the native place and there is no civil court order injuncting them from entering into the said building or premises concerned. With the aforesaid observations, the writ petition being WPA 1510 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
