Bhattacharyya, learned senior Advocate appearing for the petitioner submits that the petitioner was suspended on 4th June, 2020 and the suspension order was reviewed on 14th October, 2020 and was extended for another 3 (three) months. In the meantime, an enquiry was initiated, but has not proceeded much. Mr. Bhattacharyya prays for quashing of the suspension order dated 4th July, 2020.

Mr. Majumder, learned Counsel appearing for the Visva Bharati University submits that because of Covid pandemic the enquiry proceedings could not be completed. The Executive Council has extended the suspension order for another 3 (three) months for completion of the enquiry proceedings.

Heard both the parties.

As an enquiry has already been initiated, the enquiry officer is requested to conclude his enquiry as early as

possible, and submits his report before the Executive Council. The Executive Council shall take a final decision after considering the enquiry report, regarding the suspension of the petitioner. The entire proceedings of enquiry and the decision to be taken by the Executive Council, should be concluded within a period of 3 (three) months from today.

The writ petition being WPA No. 1569 of 2021 is disposed of without, however, no order as to costs. Since no affidavit is called for, the allegations made in the writ petition are deemed to have been denied. Urgent photostat certified copy of this order, if applied for, be given to the parties on the usual undertakings.
