Learned advocate appearing on behalf of the appellants submits that his clients are not willing to proceed with the present second appeal and files a written instruction of his clients to the said effect, which is taken on record.

SA 314 of 2007 is therefore dismissed for non prosecution.

There shall be no order as to costs.

Interim order, if there be any, stands vacated. The department is directed to send down the connected lower Court records immediately to the Court below.

Urgent photostat certified copy of this order, if applied for, be supplied to the party subject to compliance of all requisite formalities.
