Learned advocate appearing on behalf of the petitioner is aggrieved by the fact that Misc. Case No. 145 of 2016 dated 18-112016 is continuing before the learned A. C. J. M., 2nd court, Kalna, Purba Bardhaman for the last 7 years and the petitioner in spite of his best efforts is unable to complete his case as the opposite party/wife is evading cross-examination.

I find from the records of the case that the learned Judicial Magistrate, 2nd court, Kalna has been very diligently fixing dates but for reason or the other the cross-examination of the prosecution witness no. 1 is not being completed. Having considered that the case is pending for a period of seven years or more, I direct the learned trial court to fix dates in the same mode and manner as already fixed but take harsher steps so that the prosecution witness is completed by 31st November, 2024. Thereafter, if the present petitioner as Opposition witness intends to adduce evidence he may be granted four months time. The learned trial court will try to pronounce the verdict on or before 31st March, 2025.

With the aforesaid observations, the revisional application being CRR 259 of 2024 is disposed of.
