Learned advocate appearing for the petitioners submits that recovery was from the house of the petitioner no.1 and unnecessarily the petitioner no.2 has been implicated in connection with the instant case. The subject-matter of the case relates to recovery of 1.2 kgs. of heroin and the petitioners are in custody for about 578 days. Learned advocate appearing for the NCB, on the other hand, opposes the prayer for bail and submits that not only contraband/heroin has been recovered in the present case, but also arms, money trail and CDRs have been revealed in course of investigation. Further, the petitioner no.2 has signed on the seizure list and there is videography of the incident concerned.

Having considered that other accused persons are absconding presently and the process of tracing out the other accused are being pursued, I am of the opinion that at this stage, it would not be fit and proper to release the petitioners on bail. As such, the prayer for bail of the petitioner is rejected.

Report submitted by the learned advocate appearing for the NCB be kept with the record.

The application for bail, being CRM (NDPS) 186 of 2026, is, thus, dismissed.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
