The petitioner has challenged the notice under Section 10(1) of the West Bengal Highways Act, 1964 issued on 11th January, 2023.

It is submitted on behalf of the petitioner that pursuant to the said notice an order under Section 10(3) of the Act of 1964 has been passed by the Sub-Divisional Officer, Purba Medinipur which has been carried in appeal under Section 10(4) of the Act.

In view of the same, the writ petition, being WPA 1317 of 2023, has become infructuous and is accordingly disposed of.

There shall however, be no order as to costs. Urgent certified website copy of this order, if applied for, be furnished to the parties on usual undertakings.
