1. This application under section 442 read with section 528 of the BNSS has been filed for expeditious disposal of the hearing of the application filed for return of seized articles within a specific time.

2. It is submitted by the learned advocate appearing on behalf of the petitioner that on the basis of complaint lodged by the opposite party No.1 against the petitioner, Nagerbazar P.S. Case No.287 of 2023 under section 417/376/506 of IPC was initiated. Pursuant to the said case the petitioner was arrested and subsequently enlarged on bail by the learned Chief Judicial Magistrate, Barrackpore, North 24 Parganas. It is the further case of the petitioner that in connection with the said case certain articles including the mobile and laptops were seized by the Investigating Officer of Nagerbazar Police Station. Subsequently, the petitioner filed an application on 23rd August, 2023, for return of the seized articles.

But after the report with regard to seized articles submitted by the Investigating Officer on 21st September, 2023, the learned court below directed only to keep the same with the record but there was no whisper of return of the seized articles in the said order.

3. Perused the case record and the various orders passed by the learned trial court which further reveal that the charge-sheet has been submitted on 13th December, 2023, against the present petitioner.

4. In view of the above, the learned court below is directed to expedite the application filed on behalf of the present petitioner and to dispose of the same within the legal parameters, within a period of one month from the date of receipt of server copy of this order duly downloaded from the official website of this Hon'ble Court.

5. The learned advocate appearing on behalf of the petitioner is directed to communicate this order to the learned advocate appearing for the opposite party No.1 in this Court as well as in the learned court below.

6. Urgent Photostat certified copy of this order, if applied for, be given to the parties, on priority basis, upon compliance of all necessary formalities.

7. With the aforesaid direction, the revisional application is disposed of.
