Petitioner is in custody for more than four years. He submits no prosecution witness has been examined till date. Co-accused has been granted bail by the Hon'ble Apex Court. He prays for bail.

Learned Advocate for the State opposes the bail prayer. We have considered the materials on record. Though petitioner is in custody for more than four years, no witness has been examined. Co-accused has been enlarged on bail by the Hon'ble Apex Court.

Under such circumstances, we are inclined to grant bail to the petitioner.

Accordingly, we grant bail to the petitioner in terms and conditions to the satisfaction of the trial court. This application for bail is, thus, disposed of. (Ajay Kumar Gupta,J.) (Joymalya Bagchi, J.)
