-AndIn the matter of : Kalyan Ghosh ... ...Petitioner Mr. Surya prasad Chattopadhyay, Mr. Arjun Samanta, Advocates ... ... For the Petitioner Mr. Sataroop Purakayastha, Ms. Jagriti Bhattacharya, Advocate ... ...For the de facto complainant Mr. Rudradipta Nandy, Advocate ... ...For the State Petitioner seeks anticipatory bail.

A report was called for by an order dated January 31, 2022.

Report filed in Court today be taken on record. It appears that the petitioner persuaded the mother of the de facto complainant who is of 90 years of age and staying in an old age home apparently run by the petitioner to part with money to the petitioner. The petitioner is yet to refund the entirety of the amount. That apart there is one other accused involved who is yet to be arrested. Such other person also is yet to return any money to the mother of the de facto complainant. Considering the gravity of the offence and the involvement of the petitioner therein and considering the fact that the petitioner is dabbling with the public with

regard to an old age home, we are not inclined to grant anticipatory bail to the petitioner.

Personal appearance of the IO is dispensed with. Prayer for anticipatory bail is rejected.

This application for anticipatory bail is dismissed. (Debangsu Basak, J.) (Bibhas Ranjan De, J.)
