Learned counsel for the petitioner, in his usual fairness, submits that the petitioner, although a poor agriculturist, is willing to deposit all dues as per the Distribution Licensee for getting reconnection of power supply to his submersible pump.

Learned counsel appearing for the Distribution Licensee submits that the connection to the concerned meter was severed long back on September 29, 2012. That apart, such connection had been initially given in the name of the petitioner's grand-father and not the petitioner.

It is further submitted by learned counsel for the Distribution Licensee that the petitioner is to provide a SWID certificate, since the zone where the submersible

pump is situated, may in critical area insofar as groundwater resources are concerned. Be that as it may, since there is requirement of a SWID certificate in law, in view of the specific stand taken by the Distribution Licensee, it would be appropriate if the petitioner is permitted to apply for a fresh electric connection in the petitioner's own name.

Accordingly, WPA 1244 of 2022 is disposed of by granting liberty to the petitioner to file an application for reconnection in the petitioner's name.

If such an application is filed, subject to compliance of all formalities, including submission of a SWID certificate and payment of all due amounts by the petitioner, the Distribution Licensee shall give reconnection to the petitioner at his submersible pump as expeditiously as possible, preferably within three weeks from the date of compliance of formalities.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
