Mr. Tapan Kumar Rakshit, Mr. Surajit Roy ...for the petitioners Mr. Ansar Mondal, Ld. AGP Mr. Md. Idrish ....for the State Affidavit of service filed in Court today is kept with the record.

Petitioner is aggrieved firstly regarding their property being encroached at the behest of the private respondent and also their life being at stake because of the private respondents.

Learned advocate for the State has submitted a report prepared by the Officer-in-Charge, Rajapur Police Station, Howrah (R). So far as the right, title and interest is concerned and the legality and illegality of the construction at the land of the petitioner, petitioner would be at liberty to approach the jurisdictional Civil Court.

So far as the issue being relating to threat, abuse, harassment they have complained before the police authorities and they are aggrieved by the fact

that no steps have been taken, the Officer-in-Charge of Rajapur Police Station will ensure that at the behest of the private respondents the present petitioners are not subjected to any threat, abuse, harassment.

Petitioner would be at liberty to invoke the provisions of Section 175 (3) of BNSS of the Jurisdictional Magistrate, in case they find that in spite of the complaint, the police authorities are not acting.

Report so submitted be kept with the record. A copy of the report be handed over to the learned advocate appearing on behalf of the petitioner. With the aforesaid observations, the writ petition being WPA 1310 of 2024 is disposed of. There shall be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
