Mr. Sinha, learned advocate for the State has filed a report through the Inspector of Police/Officer-in-Charge, Sinthi Police Station dated 12.10.2023 which stated that the opposite parties i.e. Banwari Lal Agarwal and Radheyshyam Agarwal have expired on 15.01.2013 and 19.01.2021 respectively supported by copies of their death certificates. Let the said report be kept on record. The instant appeal was filed against judgment and order dated March 23, 1998 passed by the Municipal Magistrate, Calcutta in connection with the case No. 3D of 1986 acquitting the opposite parties of a charge under Section 16(1)(a)(I) read with Section 6 and 7 of the presentation of Food Adulteration Act, 1954. Under the facts and circumstances, on the demise of the opposite parties, the instant appeal gets abated and accordingly disposed of.

Copy of the order be sent to the Department as well as learned trial court for due compliance.
