CONSTITUTIONAL WRIT JURISDICTION WPA No. 641 of 2020 Sukamal Bhattacharjee -vs- The Kolkata Municipal Corporation & Ors.

Mr. Debashis Banerjee for the petitioner Mr. Ranajit Chatterjee for the KMC The petitioner complains illegal and unauthorized construction being carried on by the private respondents. None appears on behalf of the private respondents despite service.

The petitioner has made a representation before the Executive Engineer, Building Department of the Kolkata Municipal Corporation as well as before the Officer-inCharge of the Parnasree Police Station in December 2019.

The petitioner alleges that neither the Corporation nor the Police have taken any steps against the alleged complaint lodged by the petitioner.

The learned advocate representing the Kolkata Municipal Corporation submits, upon instructions, that a stop work notice has been issued in favour of the person(s) responsible for making construction on 18th January 2020. It has been submitted that despite the

stop work notice, construction is being carried on by the person(s) concerned.

In view of the aforesaid submission, the instant writ petition is disposed of by directing the Kolkata Municipal Corporation to take necessary steps in accordance with law against the unauthorized and illegal construction that is being made in the premises in question. Such steps shall be initiated at the earliest and concluded within a period of six months from the date of communication of a copy of this order.

WPA 641 of 2020 is thus disposed of.

Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
