The petitioner is the wife of a deceased employee of the Berhampore Municipality, District - Murshidabad, who died in harness. It is the contention of the petitioner that the municipal authorities have not yet completed the service book of the petitioner's deceased husband and have not sent the necessary papers to the office of the Director of Pension, Provident Fund & Group Insurance. As a result of which, the Pension Payment Order has not yet been issued.
Learned advocate appearing for the municipality submits that all relevant papers have already been forwarded.
Learned advocate appearing for the State submits that the State respondents do not have any
information as to whether such documents have been received by the Director of Pension, Provident Fund & Group Insurance.
Under such circumstances, the writ petition is disposed of with a direction upon the authorities of the Berhampore Municipality to complete the service book of the petitioner's husband, if not already done, and send all relevant papers to the appropriate authorities so that the Pension Payment Order may be issued in accordance with law and steps be taken for release of the death-cum-retirement benefits of the deceased employee.
As this is a case of a widow praying for the rightful entitlement of her deceased husband, this court is of the opinion that the matter shall be taken into consideration by the appropriate authorities with the seriousness that it deserves and steps are accordingly taken to ensure that the death-cumretirement benefits of the deceased employee is released in accordance with law within a period of 12 weeks from the date of communication of this order. The writ petition is, thus, disposed of. There shall be no order as to costs.
