Mr. Supriyo Shasmal Mr. Souvik Das ...for the petitioner Ms. Sreyashee Biswas Ms. Nandini Chatterjee ..for the State Report filed on behalf of the State is taken on record. Learned senior counsel appearing on behalf of the petitioner submits as follows. The petitioner is a Sub-Post Master. It is alleged that although a sum of Rs. 2 lakh was deposited by the de facto complainant in the post office and a passbook was issued, the said amount was not actually credited to her account. Depositions made in the departmental enquiry of the petitioner would show that the de facto complainant had allegedly deposited such money through an agent, namely Dipali Samanta, and the passbook was also received from the said Dipali Samanta.

Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. However, the passbook in question was issued not in the name of the de facto complainant, but in the name of one Prabodh Adak, and bank statements are available to show that

the cheque in question was paid by the de facto complainant to the said agent Dipali Samanta.

Considering the above, the other materials available in the case diary and the alleged role ascribed to the present petitioner, I do not think that custodial interrogation of the petitioner is required in this case and I am inclined to grant anticipatory bail to the petitioner. In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on further conditions that the petitioner shall meet the Investigating Officer once a fortnight till submission of report in final form and shall not threaten or intimidate the witnesses.
