Rakib (Rejected) CRM (M) 269 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Nager Bazar Police Station case no. 215 of 2024 dated 12.08.2024 under Sections 498A/323 of the Indian Penal Code read with Sections 8 and 12 of the POCSO Act, 2012.

Learned advocate appearing for the petitioner submits that petitioner is in custody for one year seven months and till date only one witness has been completely examined while the evidence of PW2 is in progress.

Learned advocate for the State has produced the Case Diary and it is found that the allegations have its genesis in a matrimonial dispute between the mother of the victim and father of the victim.

Having considered the period of detention of the present petitioner which is for one year seven months and the prosecution has relied upon 13 witnesses, I direct that after the crossexamination of the victim is over the petitioner be released on bail

on such terms and conditions as the learned Special Court deems fit and proper.

With the aforesaid observations, CRM (M) 269 of 2026 is disposed of.

Report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
