Anjan Roy v. Union Of India And ORS.
06.02.2025 Item No.4 PG/AG Ct. No.1 W.P.A.(P) 20 of 2025 Anjan Roy
Versus
Union of India & Ors.
Mr. Suddhasatwa Banerjee Mr. Avrin Chakraborty Md. Zohaib Rauf .....for the Petitioner Mr. Asok Kr. Chakraborty, Ld. ASG Ms. Amrita Pandey.............for the Union of India
1. We have heard the learned advocate for the petitioner and we find that the writ petition is not a genuine public interest litigation and more particularly because the annexures to the writ petition contains documents relating to certain patients, which are all personal details, which ought not to have been enclosed as supportive documents to the writ petition. Apart from that there are documents, which are copies of tenders, the source of which has not been mentioned in the writ petition.
2. Above all, before approaching this Court for issuance of a writ of mandamus, the writ petitioner, who calls himself as a social worker associated with a Non-Governmental organisation, has not approached the appropriate authority by way of a comprehensive representation.
3. Above are the sufficient grounds to dismiss the writ petition. Accordingly, the writ petition is dismissed.
4. No costs.
5. Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
