Mr. Prosenjit Mukherjee ..for the private respondent Mr. Jahar Datta Mr. Jaladhi Das ...for the State The grievance of the petitioner is directed against the failure of the respondent/CESC Ltd. to provide the petitioner with a fresh electricity connection on the existing meter board.

The private respondent is represented and submits that he is the landlord and the petitioner is paying only Rs.56/- as rent with the Rent Controller.

The CESC Limited is represented and submits that the inspection has not been completed on the said premises.

I have heard the parties.

In view of the fact that the petitioner seeks an essential service, I am of the view that the private disputes between the petitioner and the private respondent cannot be a ground to refuse the petitioner from giving a fresh electricity connection.

Accordingly, I direct the respondent/ CESC Limited to provide the petitioner a fresh electricity connection on

the existing electric meter board upon completion of inspection and after compliance with all formalities by the petitioner.

It is made clear that the grant of fresh electricity connection will not create any equity in favour of petitioner in so far as the civil disputes between the petitioner and the private respondent are concerned.

The Officer-in-Charge, Karya Police Station, Kolkata is directed to render the police assistant to the CESC Limited for which the petitioner will bear the cost exclusively.

It is expected that the entire exercise will be completed within six weeks from date upon compliance with all formalities by the petitioner.

With the aforesaid directions this writ petition being WPA No. 1630 of 2021 stands disposed of.

There shall be, however, no order as to costs. (Ravi Krishan Kapur,J)
