Report submitted by the learned advocate appearing for the State be kept with the record. Learned advocate appearing for the petitioner alleges that the private respondent nos. 6 to 11 are trying to encroach upon the property of the petitioner and to that extent, petitioner has been threatening and/or using excess force.

I have considered the representation which was addressed to the Officer-in-Charge, Domjur Police Station. State has submitted a report which reflects that at the relevant point of time, police authorities registered a case being Domjur Police Station Case No. 179/2023. Subsequently chargesheet has also been submitted in connection with the said case and it has been categorically observed that no construction work is going on over the alleged property. Having considered the time period which has lapsed in the meantime, I direct that in case the petitioner faces the same inconvenience, she would be at liberty to approach the police

authorities. The police authorities would consider the same in accordance with law.

With the aforesaid observations, the writ petition being WPA 1364 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
