Learned advocate appearing for the petitioner submits that petitioner is in custody for two years five months and only two witnesses have been examined completely and the evidence of 3rd witness is in progress. It has also submitted that the prosecution intends to examine 32 witnesses.

Learned advocate for the de-facto complainant opposes the prayer for bail and submits that the petitioner has been named by number of witnesses.

Learned advocate for the State has produced the Case Diary and drawn the attention of the Court to the statement of an eyewitness who has narrated that it was this petitioner who pointed out to the co-accused in respect of the identity of the victim.

Having regard to the complicity of the present petitioner who was thickly connected with the principal accused in the alleged commission of the offence, I am of the view that this is not a fit case for granting bail considering the gravity of the offence. Accordingly, CRM (M) 218 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
