Ms Sima Adhikari, Ms. Kakali Naskar, ... For the State. The mother of the petitioner was an approved Assistant Teacher. She during her lifetime applied for the benefit of ROPA 2009 but unfortunately died before disposal of her such prayer.

The petitioner is the daughter of the said deceased teacher, her marriage has been dissolved by a decree of divorce and is pursuing the said claim of her mother.

The representation of the petitioner to have the said benefit was directed to be disposed of by an order dated February 13, 2020 passed in WP 20402 (W) of 2019.

The petitioner is complaining that the said direction has not been complied with till date. Ms. Sima Adhikari, learned counsel for the State, submits that the petitioner did not turn up before the concerned authority i.e. Director of Pension Provident Fund and Group Insurance, the Government of West Bengal, the respondent no. 3

herein, as such, the said representation could not be disposed of.

The petitioner is directed to appear before the respondent no. 3 on Friday (09.06.2023) for fixation of a date of hearing of the said representation. The respondent no. 3 shall dispose of the said representation in terms of the aforementioned order dated February 13, 2020 without any further delay. WPA 1371 of 2023 is disposed of with the above terms without any order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance of all requisite formalities.
