Affidavit of service filed on behalf of the petitioner is taken on record.

Mr. Roy appearing for the petitioner submits that the writ petitioner who had filed a complaint on account of being defrauded for a sum of Rs.5 lakhs, has since received the money from the errant person with the help of the police authorities. The writ petition has, therefore, become infructuous.

Accordingly, the writ petition is dismissed.

There shall be no order as to costs.
