Galib Mrs. Sujata Ghosh ...for the State The grievance of the petitioner is directed against non-consideration of his representation dated November 28, 2019 appearing at pages 34 to 38 (Annexure-P/3) of the petition.

It is submitted by the Advocate appearing on behalf of the petitioner that private respondents have wrongfully and illegally caused obstruction to the ingress and egress of the subject premises.

The private respondents are represented and deny that there has been any obstruction caused with the ingress and egress of the subject premises belonging to the petitioner.

The State is represented.

In view of the disputes, raised by the petitioner I direct the Assistant Engineer, Haldia Highway Division, the respondent no. 3 herein to consider and dispose of the

representation dated November 28, 2019 appearing at pages 34 to 38 (Annexure-P/3) of the petition within a period of 8 weeks from date after giving a right of hearing to all the affected parties including the State and the private respondents.

It is made clear that nothing in this order in so far as the merits of the case are concerned would be binding upon the respondent no. 3 whilst considering the representation of the petitioner.

With the aforesaid directions, WPA No. 704 of 2020 is disposed of.

There shall be however no order as to costs.
