1. The petitioner prays for consideration of the representation in terms of the direction passed by a coordinate Bench of this Court on 30th January, 2024 in WPA 28078 of 2023 (Sandip Halder -Vs- The State of West Bengal & Ors). It is the stand of the petitioner that the revised rates have already been implemented in respect of several hospitals in the States.

2. As the issue in question has been decided by the Court, the instant writ petition is disposed of by directing the Director of Health Services, being the respondent no. 6 herein to take steps to consider the representation filed by the petitioner in light of the order dated 30th January, 2024 passed by the Hon'ble Court in the matter of Sandip Halder (supra) at the earliest but positively within a period of eight weeks from the date of communication of this order.

3. The aforesaid respondent shall pass a reasoned order and take necessary consequential steps in the matter.

4. Affidavit-of-service filed today in Court be kept with the records.

5. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
