Learned advocate appearing for the petitioner submits that petitioner has been implicated along with another for alleged recovery of 33.46 kgs of ganja and petitioner is in custody for one year 27 days. Additionally, it has been submitted that charges have been framed in the Month of November, 2025 and date has been fixed on in the first week of February, 2026 for witness action to commence.

Learned advocate for the State opposes the prayer for bail. Having considered that the quantum so recovered is of commercial quantity, I am of the view that at this stage at least provisions of Section 37 of NDPS Act is attracted. Thus, the prayer for bail of the petitioner is rejected.

However, the learned trial Court would if required, give priority for examination of the seizure list witnesses.

Petitioner would be at liberty to approach this Court after the evidence of the seizure list witnesses is over. At this stage, CRM (NDPS) 153 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
