Learned advocate appearing for the petitioners submits that from the petitioner no.1, 37 bottles of phensedyl and from the petitioner no.2, 21 bottles of phensedyl have been recovered. There is another accused person viz. Tanay Mondal alias Malay from whom 69 bottles of phensedyl were recovered and the said Tanay Mondal alias Malay has been granted bail in CRM (NDPS) 1261 of 2025. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that eight witnesses have already been examined.

I find that 19 witnesses have been cited and are to be relied upon by the prosecution. Having considered that the present petitioners are in custody for more than one year, I am of the view that further detention of the present

petitioners in connection with the instant case is unwarranted. As such, the prayer for bail of the petitioners is allowed.

Accordingly, the petitioners viz., 1. Samirul Mondal alias Shamirul Mondal and 2. Biswajit Roy shall be released on bail upon furnishing bond of Rs.20,000/- each, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under the NDPS Act-cum-Additional Sessions Judge, 6th Court, Barasat.

If on bail, the petitioners shall be physically present on each and every date so fixed by the learned Special Court and shall not leave the jurisdiction of the district of North 24-Parganas without prior permission of the learned Special Court.

The application for bail, being CRM (NDPS) 155 of 2026, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
