Case No.819 of 2025 dated 06.12.2025 under Sections 85/103(1)/3(5) of the BNS, 2023. And In the matter of:

APP Mr. Arani Bhattacharyya ... for the State Learned counsel for the petitioners submits that the petitioners are the mother-in-law and the unmarried sisterin-law of the alleged victim. The petitioner No.2 is a college student. The father-in-law and the husband of the alleged victim were arrested and are presently in custody. The suicide took place within eight months of marriage. Learned counsel for the State strongly opposes the prayer for anticipatory bail and relies on the statements of witnesses including the neighbours and the grandfather-inlaw of the alleged victim, all of which implicate the present petitioners as well. He submits that as per the FIR as well as the Surathal Report, the husband was involved in an extramarital relationship and he played a role in the dispute. It is alleged that the father-in-law attempted to assault the victim with a bamboo stick and the parents-in-law tortured the victim practically everyday.
Considering the above, the other materials available in the case diary and the alleged role ascribed to each of the petitioners, while I am inclined to grant anticipatory bail to the petitioner No.2, the application for anticipatory bail of the petitioner No.1 (Sabera Khatun Mondal @ Sabera Bibi) is rejected.
In the event of arrest, the petitioner No.2 (Sabnur Khatun)) shall be released on bail upon furnishing a bond of Rs.10,000/- (rupees ten thousand) with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on the further conditions that the petitioner No. 2 shall cooperate with the investigation and shall not threaten or intimidate witnesses.
The application for anticipatory bail is, thus, disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
