This revisional application has been filed for a direction upon the learned Presiding Officer of DRT-III, Kolkata to dispose of IA No. 916 of 2020 and IA No. 1320 of 2020 which has been filed by the opposite parties for stay of the sale notices, expeditiously. The petitioners/bank submits that the delay in disposal of the applications is causing loss of revenue to the bank in view of the enormous outstanding dues on account of non-payment of the secured loans by the opposite parties. The order dated January 11, 2021, reflects that the learned Tribunal is already in the midst of hearing the said applications and arguments have already been advanced by the parties.

Under such circumstances, I dispose of this revisional application with a direction upon the learned DRT-III, Kolkata to dispose of the applications being IA No. 916 of 2020 and IA No. 1320 of 2020 mandatorily within a period of seven days from the next date fixed.

It is made clear that this Court has not gone into the merits of the case and the learned Tribunal shall proceed independently and in accordance with law. Petitioners are directed to serve copies of this revisional application along with a server copy of this order upon the learned advocate appearing on behalf of the opposite parties before the learned Tribunal within two days.

There will be no order as to cost.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all formalities.
