The petitioner who is the decree holder in Title Suit No.170 of 1984, which was decreed by the learned Civil Judge (Junior Division), 2nd Court at Asansol, District Burdwan, has preferred this revisional application praying for expeditious disposal of the Title Execution Case No.02 of 2013.

It is submitted by the learned advocate for the petitioner that a recalling application is pending before the learned executing court. He prays that the learned court below may be directed to expedite the disposal of the pending applications as also the execution case. Without going into the merits of the claims of the petitioner and without making any observations with regard to the contention of the petitioner, this revisional application is disposed of with a direction upon the learned Civil Judge (Junior Division), 2nd Court at Asansol, District Burdwan to dispose of the Title Execution Case No.02 of 2013 along with all pending applications upon affording an opportunity to

the opposite party to contest the same, as expeditiously as possible, preferably within a period of three months from the next date fixed in the learned Court below.

The learned court below will proceed independently and in accordance with law without being influenced by any observations made herein.

The petitioner is directed to serve copies of this revisional application along with server copy of this order upon the opposite parties within a week from date. The revisional application is disposed of.

There will be, however, no order as to costs. Urgent Photostat certified copy of this order, if applied for, be given to the parties on priority basis. (Shampa Sarkar, J.)
