The writ petitioner prays for withdrawal of the notice dated 7th January, 2022 issued by the Assistant Engineer, PWD and the notice dated 10th January, 2022 issued by the Executive Engineer, PWD, Tamluk Division. It appears that the notice dated 7th January, 2022 has been cancelled by a cancellation notice issued by the Assistant Engineer, PWD on 10th January, 2022. Also, pursuant to the notice dated 10th January, 2022, issued by the Executive Engineer, PWD, hearing was conducted and an order passed by the Executive Engineer in the said hearing.

Therefore, the prayer of the petitioner in the present writ petition has become redundant. Nothing further remains in the writ petition for adjudication. Accordingly, the writ petition being WPA 1305 of 2022 is dismissed.

However, there shall be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
