D/L58 23.02.2026 Bpg.
dismissed C.R.M. (M) 207 of 2026 In Re: An application for bail under Section 439 of the Code of Criminal Procedure, 1973 (Corresponding under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023) filed in connection with Madhyamgram Police Station Case No.484 of 2024 dated 17.07.2024 under Sections 96/143/98/99/61(2) of the Bharatiya Nyaya Sanhita, 29023, Sections 3/4/5/6/7/9 of the Immoral Traffic Prevention Act, 1956 and Section 4 of the Protection of Children from Sexual Offences Act ; Sraboni Nath alias Srabona Nath
Versus
The State of West Bengal & Anr.
Mr. Angshuman Chakraborty Mr. Shashanka Shekhar Saha.
...for the petitioner.
Mr. Sanjay Bardhan Mr. Mujibar Ali Naskar.
...for the State.
Learned advocate appearing for the petitioner refers to the order passed in Criminal Appeal No(s).3599 of 2025 and submits that an accused Rana Gope in the present case has been granted bail by the Hon'ble Supreme Court citing that VG-2 who happens to be P.W.1 disclosed that she was interested in dance and she requested her brother-in-law to place her at a place where she could learned dance to secure her livelihood. So far as the present petitioner is concerned, petitioner prima facie seems to be part of the racket as is reflected from the deposition of the witness no.3 that she brought the victim at the house of the accused where immoral activities were taking place. The victim is 17 years old. She was forced inside the room and
locked from outside and there was sexual exploitation. Having considered the same and the locus of the present petitioner who is involved in the chain of events to the sexual exploitation of the victim, I am of the view that this is not a fit case for granting bail in spite of the duration of custody suffered. Accordingly, CRM(M) 207 of 2026 is dismissed. Petitioner is in custody for 1 year 2 months and the prosecution till date has examined two witnesses and the evidence of third witness is in progress. Charge-sheet reflects that 30 witnesses have been proposed to be examined. Consequently, the learned trial court would ensure that at least within the next six months the witnesses who are vulnerable are completed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
