The present case is of the year 2015, petitioner has been produced in this case on 13.08.2023.

Learned advocate for the NCB submits a report and adds that already one witness out of proposed six witnesses has already been examined. Since the case is of the year 2015 sometime will be consumed for tracing out witnesses.

Having considered the same and the factum that there were original recovery of 3.75 kgs of cocaine from co-accused and petitioner is a foreign national his release at this stage will further jeopardize the case. Although, the report does not reflect but it has been submitted that petitioner was earlier detained in connection with another case, as such the petitioner has antecedent. Considering the gravity of the offence and the petitioner being a flight risk, I am not inclined to release the petitioner on bail.

Accordingly, the prayer for bail of the petitioner in CRM (NDPS) 177 of 2026 is dismissed.

Learned trial Court, however, would put in efforts to expedite the process of trial.

Report submitted by NCB be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
