In this application under section CPC, Guardianship Case No. 17 of 2020 pending before the Court of learned District Judge, Murshidabad at Berhampore is sought to be transferred to the Court of the learned District Judge Suri at Birbhum since the minor girl child aged about 4 years is in the custody of her mother.

On consent of the learned advocates for the both parties, the case be withdrawn from the file of learned District Judge, Murshidabad at Berhampore to the Court of the learned District Suri at Birbhum.

However, the allegations made in the application be deemed to be denied as no opportunity is given to file objection.

Accordingly, C.O. 107 of 2021 is disposed of. (Shivakant Prasad, J. )
