Amin Mr. Archishman Singh ..for the petitioners Mr. Ranabir Roy Chowdhury Ms. Dattatreya Dutta ..for the State Learned counsel for the petitioner submits that though initially he preferred the instant application seeking quashment of G.R. Case No. 1304 of 2011 arising out of Domkal Police Station Case No. 229 of 2011 dated 21.09.2011 under Section 302, 326, 307 and 34 of Indian Penal Code but since the trial of the said sessions case is continuing the petitioners made an alternative prayer for seeking leave to surrender before the court below. Learned counsel for the State submits that the prayer made by the petitioners is innocuous and liberty may be given to them to surrender before the court below.

Having heard the learned counsel for the petitioners and the State, the instant application being CRR 314 of 2025 is hereby disposed of giving liberty to the petitioners to surrender before the court below within a period of two weeks from this date and in the event of such surrender the court below will dispose of their prayer in accordance with law without being influenced by any observation made herein. The impugned order dated 10.09.2024

by which warrant of proclamation and warrant of attachment issued is hereby stayed for a period of two weeks or till the petitioners surrender before the court below whichever is earlier. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
