The writ petition has been filed alleging that the respondent nos. 3 & 4 had raised a construction without any permission, on L.R. Dag No. 1229 of Mouza - Kakgachi which had been classified as 'Sali'. A picture has been annexed to the writ petition showing that a concrete structure had been erected on the plot. The same is an educational institution. Mr. Betal, learned advocate for the respondent nos. 3 & 4, produces a copy of the conversion certificate and the order of technical vetting of the plan granted by the Hooghly Zilla Parishad in favour of the president, Indrani Devi Institute of Education. It also appears that the requisite fees have been deposited with the Hooghly Zilla Parishad.

According to learned Advocate for the respondents, in the written objection filed before the

civil court, the correct memo number of the sanction plan had not been mentioned. This led the petitioner to file the writ petition. Learned Advocate submits that his clients are taking steps for correction of the same.

Without going into the merits of the issues pending before the learned civil court, this writ petition is disposed of recording the submissions of Mr. Betal and keeping on record a copy of the conversion certificate and the order of technical vetting passed by the Hooghly Zilla Parishad. Accordingly, the writ petition is disposed of. However, there will be no order as to costs.

All the parties are directed to act on the basis of the server copy of this order.
