(NDPS) 159 of 2026 In Re : An Application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, filed in connection with Pandua Police Station Case No. 182 of 2025 dated 10.03.2025 under Sections 20(b)(ii)(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Learned advocate appearing for the petitioner submits that the background of the case relates to four vehicles being seized, from where 103 kgs. of ganja was recovered and the petitioner has been falsely implicated as he was boarding one of the vehicles.

Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that commercial quantity of contraband has been seized. Having considered the fact that the petitioner is in custody for 325 days and charges have been framed, learned Trial Court would give priority to the evidence of the seizure list witnesses. At this stage, I am of the view that the provision of Section 37 of the NDPS Act is attracted. As such, the prayer for bail of the petitioner is rejected.

The application for bail, being CRM (NDPS) 159 of 2026, is, thus, dismissed.
