2023-07-31Hon'Ble Justice Sabyasachi Bhattacharyya2 pages

31st July, (AK) W.P.A 1419 of 2023 Aktar Halder alias Aktar Ali Mollah Vs.

The State of West Bengal and others Mr. Giasul Islam ...for the petitioner.

Mr. Debanjan Mukherjee ...for the CESC Limited.

None appears for the private respondents.

The petitioner contends, by placing reliance on the report filed by the Deputy Manager, South West Regional Office, CESC Limited, that the petitioner is agreeable to take a new loop meter at the existing common service position located in the vicinity of the petitioner's premises, as suggested in the said report.

However, the CESC Limited reiterates that, for getting free access to the existing common service position, police assistance may be required, along with appropriate directions.

Accordingly, WPA 1419 of 2023 is disposed of by directing the CESC Limited to give a new electricity connection to the petitioner by way of a loop meter from the existing common service position at the vicinity of the petitioner's premises within a fortnight from date, subject to compliance of all formalities by the petitioner.

In the event any obstruction is faced by the CESC personnel in doing so, the CESC personnel shall be at liberty to approach the respondent no.3, the Officer-inCharge of the Maheshtala Police Station, who, if so approached, shall act on a server copy of this order and give such police assistance to the CESC personnel, at the cost of the petitioner.

If need be, for the purpose of giving such access to the CESC personnel, the police personnel will be at liberty to remove any padlock or other hindrance to the access of the CESC to such service position, if put up by the private respondents and/or their men and agents. There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
