1. Parties are represented through their respective learned counsel.

2. Learned counsel for petitioners, at the outset, fairly submits that impugned order of the tribunal dated 26.08.2025 passed in O.A. No. 1239 of 2025 is an ex parte interim order.

3. The petitioners/department has already filed an application for vacation of stay and next date of hearing is 02.03.2026.

4. The singular prayer advanced is that the present petition may be disposed of by directing the tribunal to consider the application for vacation of stay and decide it expeditiously.

5. Sri Das has no objection to this innocuous prayer.

6. Accordingly, the present writ petition is disposed of by requesting the tribunal to hear the parties on the aspect of vacation of stay on its own merits and decide

it in accordance with law, preferably on the next date of hearing or at the earliest.

7. With aforesaid and without expressing any opion on merits, the petition is disposed of.
