Documents showing payment of full court-fees is kept on record. The grievance of the writ petitioners is that they were seriously discriminated against by the District Inspector of Schools in not forwarding the application for transfer which appears from Pages 27 and 29 of the writ application. I have read the reason for not forwarding such applications which appears to me is a result of some mischief as the learned advocate for the petitioners has submitted that applications for three teachers and one non-teaching staff have been forwarded by the same District Inspector of Schools while the same situation existed in the school.

However, today learned advocate for the District Inspector of Schools has come up with some materials stating that the applications for both the petitioners i.e. Debashish Naskar and Biplab Kumar Sardar have already been forwarded to the School Service Commission for their transfer. The said papers /documents (copy) handed over by the learned advocate for the State, is kept on record.

As the transfer applications are now with the School Service Commission, I direct the School Service Commission to take a decision in this regard within a period of four weeks from the date of communication of this order.

I direct the petitioner to communicate this order upon the School Service Commission immediately. With the above direction, this matter is disposed of.

Affidavit of service filed in Court today be kept on record.
