Petitioner Mr. Tapodip Gupta Mr. Suman Bhanja ... for the petitioner Ms. Puspita Saha ... for the State The petitioner is aggrieved by the fact that there has been no progress in connection with NDPS Case No. 64 of 2022 arising out of Raninagar P.S. Case No. 69 of 2022 dated 23.2.2022 in spite of the fact that the petitioner is in custody for more than two years.
Ld. Advocate submits that although charge has been framed, but, till date, out of the 12 witnesses cited by the prosecution, none of the witnesses have been examined. It has also been informed that the next schedule has been fixed on and from 11th of April, 2024.
In view of the fact that the petitioner is in custody for more than two years, the ld. Trial court would fix a schedule consisting of three days once in a month so that the trial of the case can be taken to its logical conclusion within a reasonable period of time.
In case, any witness is absent, in that case, a communication be made to the Superintendent of Police
(SP), Murshidabad, who would take steps for ensuring the availability of the witnesses and/or submit a report before the court in case any witness is not available on the date so fixed by the ld. Trial court.
Ld. Public Prosecutor conducting the case would produce the exhibits, materials and documents on the date fixed for examination of the witness concerned. All stakeholders would cooperate with the ld. Trial court so that the trial is concluded at the earliest.
With the aforesaid observations, CRR 291 of 2024 is disposed of.
Pending application, if any, is also disposed of. Report so submitted by the State be kept with the record.
