This application under Article 227 of the Constitution of India is directed against the order no.125 dated December 6, 2024, passed by the learned First Civil Judge (Junior Division) at Howrah in Title Suit No.143 of 2010.

By the order impugned, the application under Order 22 Rule 10 of the Code of Civil Procedure stood allowed. Such an order is an appealable order under the provisions of Order 43 Rule 1(L) of the Code of Civil Procedure.

At this stage, Mr. Mukherjee, learned advocate appearing for the petitioner, prays for leave to withdraw the civil revisional application with liberty to approach the appropriate forum, in accordance with law.

In the light of the submissions made by the learned advocate for the petitioner, C.O. 218 of 2025

stands dismissed as withdrawn with liberty to the petitioner to approach the appropriate forum, in accordance with law.

Learned advocate on record for the petitioner shall be permitted to take back the certified copy of the order impugned by replacing the same with the appropriate photocopy thereof.

Urgent photostat certified copy of this order, if applied for, shall be furnished to the applicant at an early date, upon compliance of usual formalities. (HIRANMAY BHATTACHARYYA, J.)
