11 21.01.2021 Sc W.P.A. 1691 OF 2021 ---------------------- (Through Video Conference) , Dinesh Chandra Halder Vs.

St The West Bengal Central School Service Commission & Ors.

,, Mr. Anindya Bose Mr. Diptendu Mandal.

... For the Petitioner Dr. Chapales Bandyopadhyay Ms. Supriya Dubey.

... For the Respondents 1.

This is an application under Article 226 of the Constitution of India wherein the writ petitioner is aggrieved by the non-consideration of his application that was made for the First State Level Selection Test for recruitment of Assistant Teachers - 2016 in Upper Primary Level of Schools.

2.

He submits that he was qualified as B.Ed. and the details of the same were there in the application form. However, he has fairly submitted that the one particular column in the application form was not filled up properly by him and for that reason his application form was cancelled in the first round. He had written a letter to the authorities indicating his mistake on January 14, 2021,

i.e. almost four and a half years after the date of making application.

3.

I have heard counsel appearing on behalf of the parties and perused the materials on record.

4.

I make it clear that the fresh round of selection does not include filing of online application, and if the online application has been rejected due to some errors and/or mistakes, the same cannot be allowed to be corrected by this Court. The process to be conducted by the West Bengal Central School Service Commission begins from the stage of Rule 12(3) of the notification dated September 20, 2016 i.e., subsequent to selection of the eligible candidates. In this particular case, the petitioner fails to qualify as eligible candidate, and therefore, no relief can be granted to him.

5.

With the above direction, the writ petition is accordingly dismissed. There will be no order as to costs. 6.

Since no affidavit-in-opposition is called for, the allegations made in the writ petition are deemed not to have been admitted.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
