In response to the complaint lodged by the petitioner the police registered Dum Dum Police Station FIR 237 of 2024 dated 1st July, 2024.

The undated report of the police signed by the Inspector-of-Police, O.C. Dum Dum, Police Station mentions that the investigation is in progress. The attention of the Court has been drawn by the learned advocate representing the private respondent to the order of the Division Bench of this Court dated 29th September, 2023 in FMAT No. 371 of 2023 (Pijush Mukherjee -vs- M/s Joy Baba Lokenath Construction & Ors) with CAN No. 1 of 2023.

It appears that the Hon'ble Division Bench has been pleased to protect the right of the petitioner to some extent.

As the police has already registered FIR, the police are directed to investigate the matter in accordance with law and conclude the same at the earliest.

In the event, the petitioner has grievance with the manner of investigation, it will be open for him to approach the learned trial Court for relief.

Be it recorded that the complaint of the petitioner was filed on 12th March, 2023 followed by repeated reminder complaints but the police registered FIR after a long period only on 1st July, 2024. The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
