Sita Devi Jhawar (Via Video Conference) On 9th June, 2017, the appellants were granted four weeks time for taking steps to regularize the appeal, i.e., to take steps for causing service upon the respondent nos.1(c) and 1(e), and also for taking steps for substitution of legal heirs of the deceased respondent no.1(d). It was made clear by the order dated 9th June, 2017 that in default, the matter shall be put up for final order. Since then, the matter did not appear in the list. The Office has filed a report that no step seems to have been taken as yet. Under such circumstances, the Second Appeal being SA 751 of 1984 stands dismissed for non-compliance of the order dated 9th June, 2017.

In view of the dismissal of the Second Appeal, the recalling application being CAN 1 of 1999 (Old No: CAN 2615 of 1999) stands dismissed accordingly.
