Sn 20.1.21 C.O. 112 of 2021 RAJARSHI DATTA VS. CHANDRIMA BHAR Ms. Sohini Bhattacharyya ..for the petitioner The defendant in Title Suit No. 187 of 2019 pending before the learned Civil Judge, Junior Division,3rd Additional Court, Alipore, District South 24 Parganas is the petitioner before this Court and prays for an order directing the learned Court below to dispose of the application for temporary injunction expeditiously. It is contended by the petitioner that an adinterim order of injunction has been passed and the said order has been extended from time to time. It is also contended that the learned Court below has not disposed of the application for temporary injunction and long dates have been fixed for hearing of the same. It is further submitted that the written objection to the said application has already been filed by the defendant.

Under such circumstances, without going into the merits of the claim of the petitioner, this revisional application is disposed of with a direction upon learned Court below to dispose of the application for temporary injunction as early as possible mandatorily within a period

of two months from the next date fixed.

The learned Court below shall deal with the matter independently without being influenced by any observations made hereinabove.

The petitioner is directed to serve a copy of the revisional application along with a server copy of this order upon the opposite party within a week from date. This revisional application is disposed of.

There will be however no order as to costs.

Urgent photostat certified copy of this order be given to the parties on priority basis, if the same is applied for.
