In view of the nature of the allegations made in the writ petition regarding the funds being credited and the petitioner being duped and that the investigation in connection with Liluah P.S. Case No.118 of dated 06.03.2024 not being investigated in a manner to trace out the fraudsters, the petitioner has approached this Court.
Mr. Ghosh, learned advocate, appears on behalf of the State and submits a report of the Inspector-in-Charge, Liluah Police Station. Report reflects that some steps have been taken and information has been sent to the Nodal Officer of Kotak Mahindra Bank. Certain screenshots of online transactions have also been taken.
However the manner in which the investigation is proceedings do not inspire confidence of this Court. Accordingly, Liluah P.S. Case No.118 of 2024 dated 06.03.2024 be transferred to the Inspector-in-Charge, Cyber Crime Police Station, Howrah City Police/Cyber Crime Police Station, Howrah Police Commissionerate.
The new Investigating Officer would be engaged by the Inspector-in-Charge of the concerned police station who would expedite the progress of the investigation and take the same to its logical conclusion within a reasonable period of time.
With the aforesaid observations, WPA 1559 of 2025 is disposed of.
There will be no order as to costs.
Report submitted by the State be kept with the record.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
