Affidavit-of-service filed on behalf of the petitioner is taken on record.

The learned advocate representing the petitioner submits that based on transfer application petitioner was recommended by the Secretary of the West Bengal Central School Service Commission vide memo dated 24th January, 2022 for transfer to Saidabad M.S.C.B. Vidyalaya, Murshidabad.

Concerned authority of the West Bengal Board of Secondary Education issued transfer order dated 28th January, 2022 but petitioner could not join the transferred post since the post was not lying vacant which prompted the petitioner to make

application online seeking re-recommendation. In support of such contention reliance is placed on a document at page 22 of the writ petition wherefrom it appears that the petitioner submitted application for re-recommendation online on 31st January, 2022. It is submitted on behalf of the petitioner till date no steps have been taken to re-recommend the petitioner for transfer to another school.

Respondents are represented by learned advocates who have submitted that due to suspension of Utsashree portal with effect from 29th September, 2022 timely steps could not be taken based on application of the petitioner seeking rerecommendation. Having considered the submissions made on behalf of the parties the writ petition stands disposed of directing the Chairman, West Bengal Central School Service Commission being respondent no.3 to call the petitioner to appear before him by six weeks from date and disclose available as well as suitable vacancies to the petitioner.

If petitioner opts a vacancy amongst the vacancies to be disclosed to her appropriate order shall be passed by the respondent no.3 in order to

re-recommend the petitioner for her transfer to another school.

Aforesaid exercise shall be completed by the respondent no.3 by eight weeks from the date of communication of this order.

There shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the learned Advocates for the parties on the usual undertakings.
