Mr. Sudip Ghosh Mr. Bitasok Banerjee ... for the State The present application under Section 439 of the Code of Criminal Procedure has been preferred by the petitioner in connection with Uluberia P.S. Case No. 222 of 2021 dated 30.06.2021 under Sections 20(b)(ii)(c) of the Narcotic Drugs and Psychotropic Substance Act.

Heard learned Advocates appearing for the respective parties and considered the materials in the case diary. It appears that contraband substance above commercial quantity was recovered from the joint possession of the petitioner and another co-accused person and as such, the statutory restrictions are clearly attracted and the petitioner's prayer for bail is refused at this stage.

The learned Advocate appearing for the petitioner submits that the petitioner is languishing in custody since 30th June, 2021 and expresses his anguish as regards delay in progress of the trial. Answering to our query, Mr. Banerjee, learned Advocate appearing for the State informs this Court that last date for framing of charges was fixed on 18.1.2022.

In the event, the charges have already been framed, the learned Court below is requested to expeditiously conduct the trial so that logical conclusion of the case may be reached at the earliest.
